Privacy statement

1. APPLICATION

In this privacy statement we explain which personal data we collect and process from you as a natural person. From now on, we are always talking about data about you as a citizen, or as another data subject, such as beneficiary, contact person in a company, etc. In whatever capacity, your rights remain the same and our board treats your data with the same care.

As a government service, Zilvermeer is part of the Province of Antwerp group. Zilvermeer's registered office is located at Zilvermeerlaan 2, 2400 Mol. More information about the activities can be found at www.zilvermeer.be.

Zilvermeer is responsible for the processing of personal data.

You must be able to trust that Zilvermeer will handle your personal data carefully and securely. In order to guarantee this, Zilvermeer has an approved information security policy. This policy is in line with the relevant legislation.

As a government agency, we ensure that we only process your data if we have a valid legal basis to do so. Zilvermeer mainly processes personal data in the context of a legal assignment or in the public interest. In a number of cases we do this on the basis of a contractual obligation or to protect the vital interests of a natural person.

In all other cases, we will ask you to consent to the processing of your data. This is the case for, among others:

  • The use of cookies on the website
  • Use of contact details for newsletters you subscribe to
  • Use of contact details in the context of customer loyalty, promotional and marketing purposes
  • Processing focused photos and videos: close-ups, portrait

In addition to targeted images, Zilvermeer also makes atmospheric images (non-targeted) of its activities, events and of the public domain. These images can be published as illustrative material through the official communication channels of Zilvermeer. No explicit permission is required for this. You do have the right to removal (see point 3.7 B).

2. PROTECTION OF PRIVACY

Your personal data will be handled with care in accordance with applicable privacy legislation[1].

Zilvermeer takes appropriate administrative, technical and physical security measures to protect personal data against accidental or unlawful deletion, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse and any other unlawful form of processing of the personal data in our possession. The level of security is determined by a data protection impact assessment.

3. DATA COLLECTION

Zilvermeer can collect your contact details, such as address, e-mail, telephone number, etc., via contact forms, surveys, competitions, newsletters, social media, cookies, click-through behaviour, e-mails, navigation data, etc.

The collection of personal data is done in three ways:

  • Zilvermeer requests your personal data directly from you.
  • Zilvermeer consults supralocal authentic government data sources, such as the national register, the crossroads bank for social security, the vehicle registration service, patrimony documentation, etc.
  • Zilvermeer receives your personal data from other government agencies, healthcare institutions, etc. in the context of your application.

When you use the publicly available WiFi network of Zilvermeer, Zilvermeer keeps the following data for 6 months.

  • MAC address of your device
  • IP address (which we provide ourselves)
  • Websites you visit (just the domains, not the pages themselves)
  • Time of the visit

4. DATA PROCESSING

a) The controller

The personal data that are collected are included in the address file of the Antwerp Province group (Koningin Elisabethlei 22, 2018 Antwerp and company number 0207.725.597).

The processing of personal data is done by employees of Zilvermeer and the group of the Province of Antwerp. All employees are subject to legal professional secrecy and sign a confidentiality statement. We do everything we can to continuously train our employees about the importance of privacy and data protection.

The employees use automated systems purchased from third parties. In addition to IT suppliers, the board also has contracts for personnel management, legal assistance, etc. These suppliers are processors who process personal data on behalf of the board. To guarantee privacy, a processing agreement has been concluded with these suppliers. These suppliers are bound by the same legal bases and security measures as those that apply to the board.

Zilvermeer and the Antwerp Province group can collaborate with other government bodies. These parties may also exchange personal data. To guarantee privacy, we always make contractual agreements about finality, proportionality, confidentiality and security of the data exchange.

b) Purposes for the processing

The group of the Province of Antwerp collects your personal data for various purposes, for example to conduct correspondence, provide information by means of newsletters or when you fill in a contact or application form on our website or send us an e-mail, then your data will be used. to answer or handle your question. This data is not used for other purposes. The legal basis for processing your personal data (consent of the data subject, necessary for the execution of an agreement, necessary to comply with a legal obligation, necessary for the fulfillment of a task in the public interest) depends on the intended purposes.

Zilvermeer may also disclose your personal data: (i) if we are required to do so by law or other legal process; (ii) to law enforcement or other government agencies in accordance with their statutory powers; (iii) when we believe disclosure is necessary or appropriate to prevent physical harm; or (iv) in connection with an investigation of suspected or actual fraudulent or illegal activity.

5. DATA RETENTION PERIOD

Zilvermeer stores personal data and bases this on the legally established retention periods.

Personal data is not kept longer than necessary. After the expiry of these periods, the personal data will be destroyed according to the procedure described in the information security policy.

6. TRANSFER TO THIRD PARTIES

Zilvermeer will not sell or rent your data to companies or persons that are not part of the Antwerp Province group. Zilvermeer considers your data to be confidential information.

Occasionally, Zilvermeer calls on an external processor. This means, among other things, that we temporarily pass on data to third parties for certain tasks or investigations. If this happens, Zilvermeer will always ensure that your data is treated confidentially and used in a secure manner. Zilvermeer always records this contractually with these processors. For example, these processors will never be allowed to use your data on their own initiative and your data must be deleted as soon as those processors have completed the assignment.

7. RIGHTS RELATING TO YOUR DATA

With regard to your personal data, you have the following rights that you can exercise:

A. You can view your data

Please let us know if you would like to see the data that Zilvermeer processes about you. 

If you exercise your right of access, the board will provide you with as complete an overview as possible of your data.

 

B. You can have your data corrected

It may happen that certain information that Zilvermeer has stored about you is not (or no longer) correct. You can always ask to have that data corrected or completed to the extent permitted by law.

 

C. You can have your data deleted

You can always ask to have data kept by Zilvermeer removed, insofar as this is permitted by law.

This is the case when:

  • the data is no longer necessary for the purposes for which we collected it;
  • the processing of your data is based solely on your consent and you decide to withdraw it;

However, the right to erasure is not absolute. Zilvermeer has the right to continue to store your data when necessary for, among other things:

  • compliance with a legal obligation;
  • the establishment, exercise or substantiation of a legal claim.

 

D. You can object to certain uses of data

If you do not agree with the way in which the board processes certain data, you can object to this. Objection that we will comply unless there are legal or imperative grounds not to do so, which is the case, for example, when we process data to ensure public safety.

In specific cases, you can request that the processing of your personal data be restricted. This is the case, for example, when:

  • you dispute the correctness of a personal data, during the period that Zilvermeer needs to check that correctness; and
  • your data are no longer necessary to achieve the purposes of the processing, but you need them for the establishment, exercise or defense of legal claims.

E. You can request to transfer your data to a third party

You have the right to request that personal data that you yourself have provided to Zilvermeer be transferred to you or directly to a third party.

The privacy legislation does provide for a number of restrictions on this right, which means that it does not apply to all data.

 

F. You can oppose automatic profiling

Zilvermeer does not use profiling based on automatic processing (algorithms).

Zilvermeer's policy is that you will not be the subject of a decision based solely on automated processing, including profiling, and may produce legal effects relating to you or have a significant similar impact on you.

 

G. The right to withdraw your consent

If the processing by Zilvermeer is based on your consent, you can revoke the consent you have given at any time.

If these conditions are met, Zilvermeer will meet your request as soon as possible and inform you about this. Exercising your rights is free of charge.

8. PROFILING FOR MARKETING PURPOSES

Profiling can be described as any form of automated processing of personal data in which this data is used to evaluate certain personal aspects relating to the individual, in particular to analyze or predict elements relating to his/her personal preferences and interests.

(See point 3.7 F) Currently, Zilvermeer does not process personal data for profiling purposes and making decisions based on a profile, including analyzing the data and drawing up statistics, models and profiles, for the purposes stated in 3.4.

If so, Zilvermeer only uses anonymous or pseudonymous data for profiling as much as possible.

 

9. COLLECTION OF DATA ON USING THE WEBSITE

In addition to the use of cookies, Zilvermeer records data when the website is visited and used. This information is anonymized to the best of our ability and only collected for statistical purposes and to be able to continue to improve the website. In some cases, data may or may not be obtained through a third party.

This data may include but is not limited to: the visitor's IP address and the date and time a page was requested, searches performed and whether or not they returned a correct result, number of times a file was downloaded, etc.

For the collection of this data, Zilvermeer uses both standard website usage logs and third-party systems: Google Analytics and Siteimprove.

 

10. STAY INFORMED ABOUT CHANGES TO THIS PRIVACY STATEMENT

Zilvermeer can amend this privacy statement. The most recent version can always be found at https://www.zilvermeer.be/en/privacy.html. The board will inform you via its website or other communication channels of any significant substantive change.
